his Acceptable Use Policy ("AUP") explains the proper
conduct of using Webscenter 's Services. By registering for
the Plan(s), and accepting the Terms and Conditions, you also
acknowledge, and accept that you are also bound by this Policy.
Our acceptable use policy is actively and strictly enforced.
Offending content or users are removed from our network, and
without refund, usually as soon as they are discovered, although
we will always inform you why any action has been taken. Webscenter
reserves the right to modify the Policy at any time, effective
upon posting of the modified
Rights of Webscenter: If
Users engage in using the Service that is in violation of
the Policies or is otherwise illegal or improper, we reserve
the right to suspend and/or terminate the Service. In most
cases, we will try to notify you of any activity in violation
of our Policies and request that the User cease such activity;
however, if the viability of the Webscenter network is seriously
threatened for some cases such as UCE/SPAM, , mail relaying,
alteration of your source IP address information, denial of
service attacks, illegal activities, harassment or copyright
infringement, we reserve the right to suspend your Service
without notification. We do not make any promise, nor do we
have any obligation, to monitor or police activity occurring
via the Service and will have no liability to any party, including
you, for any violation of the Acceptable Use Policy.
Violations.
Any violation of this policy will result
in immediate suspension and/or termination of the service
. You shall remain solely liable and responsible for your
use of Webscenter services and any all content that you display,
upload, download, or transmit through the use of the Plan(s).
Webscenter will be the sole arbiter as to what constitutes
a violation of this policy. Files on the system will not be
available for download nor will the account be activated for
future downloads. There shall be no refund for any account
which violates the AUP. In the event of an AUP violation,
any and all materials if necessary will be provided to the
proper authorities should charges need to be placed for any
infraction of local or international law.
Illegal Use:
The Webscenter Service may be used only for
lawful purposes. Transmission, distribution or storage of
any material in violation of any applicable law or regulation
is prohibited. This includes, without limitation, any copyrighted
material regardless of copyright location material protected
by copyright, trademark, patent ,trade secret or other intellectual
property right used without proper authorization, and material
that is obscene, defamatory, constitutes an illegal threat,
or violates laws.
Examples of unacceptable content or links include: pirated
software, hacker programs or archives, Warez (illegal software),sites,
IRC, Adult site, links or advertising for an Adult Site, hacker/cracker
site, hate site, gambling or Casino sites ,copyrighted music,
mp3s, etc. Webscenter reserves the right to remove any content
that we determines in its sole discretion to be harmful to
the server, networks, equipment, reputation, customer or any
other third party. Storage of any files of this nature is
not allowed in any drive/directory on Webscenter's servers.
Software downloads may only be hosted if you are the writer
and copyright owner of the software, all other software including
freeware, shareware and trial software is forbidden. This
includes but not limited to the unauthorized distribution
or copying of copyrighted software or other data, harassment,
fraud, trafficking in obscene material.
Audio and video downloads may only be hosted if you are the
creator and copyright owner of the work..Webscenter will not
tolerate harassment, fraud, trafficking in obscene material,
drug dealing, gambling/casino sites and other illegal activities.
Server Resources.
Webscenter allows reasonable usage of our
CPU and server resources for those accounts which do not harm
server performance or network integrity. Any misuse of these
resources or use of massive amounts of the resources as determined
by the System Administrators shall result in suspension of
the account. Server misuse includes overuse of the CPU or
server resources due to: excessive server hits, hit flooding,
bandwidth over-usage, bandwidth flooding, corrupt scripts,
malformed or excessive content, Including but not limited
to employing applications which consume excessive CPU time,
memory or storage space. Chat/IRC, web proxy and mailing list
scripts are not allowed on our network under any circumstances.
Streaming media can be a drain on web server resources and
as such is not allowed. CGI based message forums using flat
file databases are not recommended as they take up excessive
system resources and a PHP/ASP message forum is suggested
as an alternative.
Customer¡¯s who have incorrect or bad scripts running on shared
servers that result in increased CPU usage, slow down of the
server(s) and/or stoppage of the server will have their sites
shut down immediately until the problem is corrected. If you
are unsure about content you intend to place on our network,
please check with us before you do. We reserve the right to
determine what constitutes acceptable use.
System and Network Security:Any
form of violation of Webscenter's, or any third party's server,
system, or network security through the use of the Plan(s)
are prohibited and may result in criminal or civil liability.
Webscenter will investigate incidents involving such violations
and may cooperate with law enforcement agencies if a criminal
violation is suspected. Examples of system or network security
violations include, without limitation, the following: ..
a. Unauthorized Access or Interference: A
User may not attempt to gain unauthorized access to, or attempt
to interfere with or compromise the normal functioning of
any network, system, computing facility, equipment, data,
or information. This includes, without limitation: (1) distributing
or hosting content, destructive or harmful content including,
without limitation, viruses, Trojan Horses, worms, time bombs,
eggdrops, cancel bots or any computer programming routines
that may damage or interfere with any system, program, data
or personal information; (2) any form of hacking or unauthorized
access, which includes, without limitation, use probing, or
scanning of systems security or authentication measures, data
or traffic; (3) interference with service to any user, host,
or network including any form of attempts to overload a system,
any form of system attacks, or forgery which can come from
any kind of program/script/command or messages of any kind
designed to interfere with a user's terminal session, via
any means, locally or by internet; (4) any form of interception
which includes, without limitation, unauthorized monitoring
of data or traffic on any network, server or system without
express authorization from the owner; (5) any form of avoidance
of system restriction; (6) and any form of failure to safeguard
accounts which includes, without limitation, failure to prevent
unauthorized access by giving away passwords. (7) A User may
not attempt to gain unauthorized access to the user accounts
or passwords of other users. (8) A User may not use the Service
to engage in any activities that may interfere with the ability
of others to access or use the Service or the Internet
b. UCE/Spamming/Mailbombing:
A User may not use the Service to transmit excessive volumes
of unsolicited commercial e-mail messages or deliberately
send excessively large attachments to one recipient. Any unsolicited
commercial e-mail messages or a series of unsolicited commercial
e-mail messages or large attachments sent to one recipient,
constitutes Unsolicited Commercial E-mail "UCE"
and is prohibited.
In addition, "spamming" or "mailbombing"
is also prohibited. Use of the service of another provider
to send UCE, spam or mailbombs, to promote a site hosted on
or connected to the Webscenter network, is similarly prohibited.
Likewise, you may not use the Service to collect responses
from mass unsolicited e-mail messages. Spamming, the sending
of unsolicited mass email through Webscenter's server is strictly
prohibited. Spamming includes, without limitation: (1) any
form of advertising such as commercial advertising; (2) informational
announcements to people who do not request them; (3) harassing
e-mails, whether through language, frequency, amount, or size;
(4) chain letters; (5) malicious e-mail such as "mail
bombing"; (6) e-mail containing forged or false information,
including the mail-sender and routing information, and subject
header; (7) any Safe-list mass mailer; (8) script run on and/or
from Webscenter's servers sending out mass-mail.
Any report generated by an independent firm advising Webscenter
as to a possible spamming account will result in the suspension
of the account until such time as the account is vindicated
or it has been concluded that the aforementioned account has
proven to be spamming. You will also violate this policy if
you use the services of other ISP or IPP to spam, but channeling
these activities to your Plan(s) on Webscenter's server. Webscenter
will be the sole arbiter as to what constitutes a violation
of this provision. Any violation of this provision will result
in immediate termination of your account, plus accessed a
minimum fine of $100.
Legal use of Mass-mailing features
must follow all of these requirements:
(1) User joined the specific list in use on their own free
will; (2) user has the ability to remove their name from that
specific list; (3) the previous ability needs to be on each
e-mail sent to the user;
c. Spoofing/Fraud Content: A User may not
attempt to send e-mail messages or transmit any electronic
communications using a name or address of someone other than
the User for purposes of deception. Any attempt to impersonate
someone else by altering a source IP address information or
by using forged headers or other identifying information is
prohibited. Any attempt to fraudulently conceal, forge, or
otherwise falsify a User's identity in connection with use
of the Service is prohibited.
Offering or distributing any fraudulent goods, services, schemes
or promotions (e.g. - make money fast schemes, chain-letters,
pyramid schemes), or submitting false data on any sign-up
form, contract or online application through registration,
or any fraudulent use of information obtained through the
use of the Plans, including, without limitation, use of credit
card numbers, phone numbers, e-mail addresses, or home addresses
is strictly prohibited.
d. E-mail Relay Any use of another party's
electronic mail server to relay e-mail without express permission
from such other party is prohibited.
e. Usenet Posting: All postings to USENET
groups must comply with that group's charter and other policies.
Users are prohibited from cross posting to unrelated news
groups or to any news groups where the post does not meet
that group's charter. Continued posting of off-topic messages,
including commercial messages (unless specifically invited
by charter), is prohibited.
f. Unauthorized Actions: Unauthorized access
to or use of data, systems or networks, including any attempt
to probe, scan or test the vulnerability of a system or network
or to breach security or authentication measures without express
authorization of the owner of the system or network. Unauthorized
monitoring of data or traffic on any network or system without
express authorization of the owner of the system or network.
Interference with service to any user, host or network including,
without limitation, mail-bombing, flooding, deliberate attempts
to overload a system and broadcast attacks.
g. Other Prohibited Activiities: The following
activities are also prohibited: Attempting to intercept, redirect,
or otherwise interfere with communications intended for others.
Intentionally transmitting files containing a computer virus
or corrupted data. Any other inappropriate activity or abuse
of the Service (as determined by us in our sole discretion),
whether or not specifically listed in these Policies, may
result in suspension or termination of the User's access to
and use of the Service.
Adult Content.
Adult-oriented sites, pornography and sex-related
merchandising are prohibited. This includes sites that may
infer sexual content of any kind or provide links to adult
content elsewhere. We also prohibit sites that provide storage,
sale, distribution, hypertext link to, advertisement, promotion
or hosting of material that is unlawful, defamatory, obscene,
harmful, threatening, harassing, or an intrusion of privacy
or publicity rights, or otherwise objectionable.
General Scripts/CGI-scripts.
General Scripting/CGI-script sharing among
domains not hosted by Webscenter is strictly prohibited. Any
General Scripting/CGI-script considered to be harming system
performance or network integrity will be shut down without
prior notice. Webscenter will not be held responsible in any
way for the downtime associated with Customer¡¯s bad scripts
that require closure of the responsible site, nor will any
financial remuneration or refund be issued for such a closure.
Dumpsite.
Webscenter does not allow for storage or
backup of files on our shared servers regardless of copyrights.
Any content placed outside the root directory of a website
will be reviewed by an administrator. Should an administrator
deem this content to be inappropriate, or in abuse to our
generous storage limits, the content will be considered to
be in violation of AUP Article 3 and will be removed from
our servers without prior notice.
Nuke Programs.
All nuke programs (e.g. PHPNuke, PostNuke,
etc.) are prohibited on Webscenter's servers and network.
Any and all instances of the program running will result in
an immediate suspension/termination of the account thus initiating
system administrator review
Piracy.
We do not allow any kind of illegal software
downloads on our servers. Any violation of this, will result
in termination of the your account.
Complaints regarding Illegal
Use or System or Network Security, SPAM, usenet issues should
be sent to: abuse@webscenter.com.
Infringement Claims: It
is the policy of Webscenter to respond promptly to claims
of intellectual property infringement. After receiving a claim
of infringement, Webscenter will take appropriate actions
under the applicable intellectual property laws. Upon receipt
of notices of possible infringement, , Webscenter may remove
or disable access to any material claimed to be infringing.
We will cooperate with appropriate law enforcement agencies
and other parties involved in investigating claims of illegal
or inappropriate activity.
