Webscenter provides web hosting services which may be used for lawful purposes only. All subscriber must accept the following. terms and conditions:

1. Illegal Use and Indemnification

Transmission or storage of any information, data or material in violation of Hong Kong law is prohibited This includes, but is not limited to: copyrighted material, pornography materials, hacking & cracking activities, sending spam mail ( sending of unsolicited email ) or any other legally unacceptable activities. The subscriber agrees to protect and hold Webscenter harmless from and against any claims arising out of or related to the service provided by Webscenter to the subscriber. Webscenter will be the sole arbiter as to what constitutes a violation of this provision. Webscenter reserves all rights to terminate the subscriber account and usage without prior notice and refund.

2. Account Information

Subscribers should provide accurate and updated personal or company information in application. Subscribers are responsible to inform Webscenter any changes of contact details such as email, telephone and fax number. Webscenter reserves the rights of account suspension and termination to the subscribers without prior notices when Webscenter cannot contact the subscribers.

3. Disclosure

Webscenter may reveal any information it deems necessary or appropriate, including, without limitation, user profile, usage history, material contained on Webscenter system in order to abide by any applicable laws, lawful governmental requests, to protect Webscenter systems and customers, or to provide and protect the quality, functionality, and integrity of Webscenter business and equipment. Webscenter reserves the right to report any activities that it suspects violates any laws or regulations to the appropriate law enforcement officials, regulators or any other appropriate third parties.

4. Server Resources

Webscenter allows acceptable usage of our CPU and server resources. Any misuse of these resources shall result in suspension of the account. Server misuse includes overuse of the CPU or server resources due to: excessive server hits, hit flooding, corrupt scripts, malformed or excessive content etc. This includes, but not limited to the following applications: - Any Chat/IRC or CGI based message forums (PHP/ASP is suggested for message forum) - Using of Leoboard XP Version;- Guestbook;- Web Proxy, Download server and game server etc- Mailing list scripts-Streaming media- Spamming or mailbombing

5. Service Termination

Should the subscriber terminate the service, the applicant must inform us by email 15 days before the termination date. Otherwise, we will regard as continuing the subscription. Webscenter reserves the right of account removal and service termination to the subscribers who has not settled the required payment before the expiration date. In such cases, Webscenter will not be responsible for any loss of the subscribers. During the service period , we will charge the service according to the length of subscription. If subscriber terminate by themselves or violate the Acceptable to Use Policy (AUP), we will not refund any part of the payment. We will inform subscriber 14 days before we terminate all or part of service due to any reason.

6. Billing Period

When subscriber sign up for Webscenter service, we will inform subscriber about the service commencment date and expiry date with e-mail. Billing will be counted starting from the commencing date. Subscriber should inform us for any discrepancy within 3 days after email notification. If subscriber did not contact us, we will regard as acceptance of our service terms and commencement date.

7. Billing and payment method

• a) Payment method has been stated on the application form.
• b) We have right to adjust the service charge. We will inform subscriber of any change with e-mail one month before effective date. For any paid charges by subscriber, subscriber is not required to pay for any additional charges. Vice versa, we will not refund any difference after payment.
• c) Subscriber should pay according to our invoice. Should the subscriber have any objection, subscriber should state the reason of objection with e-mail before the issuance of next invoice. If we do not receive any notice, subscriber cannot refuse to settle the payment.
• d) About service renewal, subscriber should settle all outstanding amount before the deadline of payment. Otherwise, we serve the right to terminate the service.
• e) If we do not receive any notice after 90 days of payment. The payment will be regarded as non-effective.

8. 30 Days Refund Guarantee

Subscriber can request for refund after 14 days of service commencement. However, the refund will not include Domain Name subscription fee.

9.Account Management.

Subscribers is responsible for keeping all their accounts and password information confidential He should report to Webscenter immediately for any unauthorized login; Subscriber should be responsible to keep track of all the account movement or usage; and perform a complete logout for a login.

10. Rights to amend service plan

Webscenter reserves the rights to amend any service package, facility or network configuration and topology without prior notice to subscribers.

11. Indemnification

Subscriber shall fully indemnify Webscenter against any kind of cost or data damage and losses, inconvenience or any incidental or consequential damages incurred by Webscenter as a result of any claim made by third parties against subscriber or Webscenter related to the services.

12. Amendment

Webscenter reserves the right to revise, amend, or modify this Terms of Service at any time and in any manner. Notice of any revision, amendment, or modification will be posted in our website without prior notice.
